Settlement Summary

Progressive Premium Insurance Co. has agreed to a $43 million settlement to close a class-action lawsuit. The lawsuit claimed the company undervalued total loss vehicle claims in Georgia. The issue surrounded a methodology that Progressive used, which plaintiffs argue resulted in policyholders receiving less than what they were owed. The settlement benefits Georgia residents who made a first-party claim on a vehicle, based on an Instant Report from Mitchell, with a Projected Sold Adjustment applied to at least one comparable vehicle. The timeline of affected claims spans from 2015 to 2025, and the settlement applies to policyholders of both Progressive Mountain Insurance Co. and Progressive Premier Insurance Co. of Illinois. Under the terms of the settlement, class members are eligible to receive a cash payment, averaging $173. However, this amount is subject to change depending on the number of eligible class members participating in the settlement. The final approval hearing is slated for May 15, 2025.
