The renowned snack manufacturer, Old Lyme Gourmet, has agreed to pay a $4 million settlement to resolve claims that it falsely advertised its Deep River brand potato chips as non-GMO, when in fact, they contained genetically modified ingredients. The settlement benefits consumers who bought these “non-GMO” labeled chips between February 2, 2017, and December 6, 2024. The lawsuit alleges that Old Lyme used a “non-GMO ingredients” graphic to trick consumers into thinking that a reputable third-party organization, like the Non-GMO Project, had certified their products. The company, while not admitting any wrongdoing, has agreed to settle the lawsuit to resolve these false advertising claims. Under the terms of the settlement, class members can claim varying amounts depending on proof of purchase. The deadline for exclusion and objection is set for March 25, 2025, and class members must submit their claim form by July 28, 2025, to receive settlement benefits.
