Settlement Summary

In November 2023, LoanCare, a national mortgage loan subservicer, experienced a cybersecurity incident that led to the compromise of sensitive consumer information. The details compromised included names, addresses, social security numbers, and loan numbers. Following this breach, a class action lawsuit was filed against the company, stating that LoanCare could have prevented the breach through more robust cybersecurity measures. This lawsuit resulted in a settlement where LoanCare agreed to pay $5.9 million, though not admitting any wrongdoing. Eligible claimants can either avail reimbursement for documented expenses or losses, or a flat-rate payment. Reimbursement payments can go up to $1,500 for ordinary losses such as credit monitoring services, fees, and other communication charges. For significant losses including unreimbursed fraud or identity theft damages, claims can go up to $5,000. In case no losses were experienced as a result of the breach, a flat-rate payment of $100 can be claimed. Additionally, all members of the class action lawsuit can avail three years of identity monitoring services.
