Settlement Summary

New Mexico drivers buy underinsured motorist (UIM) coverage to protect themselves when an at-fault driver’s liability insurance isn’t enough to cover medical bills, lost wages, and other damages. In this case, policyholders insured by Property and Casualty Insurance Co. of Hartford (Dec. 29, 2014–Mar. 18, 2022) or Hartford Insurance Co. of the Midwest (Jan. 1, 2019–Mar. 18, 2022) alleged that the companies sold UIM coverage but then treated it in a way that could leave consumers with less protection than they reasonably expected—by reducing or denying UIM payouts after subtracting (“offsetting”) amounts paid by the at-fault driver’s insurer. The lawsuit was filed because plaintiffs argued those offsets effectively made the coverage misleading or “illusory” for some customers, even though premiums were collected for it, and it challenged whether Hartford’s handling of UIM claims aligned with New Mexico’s consumer-protection expectations for how UIM coverage should work. The proposed settlement creates two paths for class members: (1) injured claimants whose benefits were reduced or denied due to an offset can seek an additional payment tied to the offset amount (subject to a damages review), or (2) policyholders can elect a premium refund equal to 23% of UIM premiums paid during the class period; attorneys’ fees are capped at $617,500, and the claim deadline is May 22, 2026. More broadly, disputes over UIM “offsets” show up nationwide because auto insurers and regulators wrestle with the same tension: preventing double recovery while ensuring the coverage sold actually delivers meaningful, predictable benefits when a crash happens. These cases often turn on state-specific insurance statutes, policy language approved by state regulators, and court interpretations of whether UIM is meant to “stack on top of” the at-fault driver’s coverage or be reduced by it, making this settlement part of a wider industry pattern of litigation and regulatory scrutiny over how UIM benefits are calculated and disclosed to consumers.
