Settlement Summary
Hapy Bear Surgery Center, a pediatric dental surgery establishment in Tulare, California, reached a settlement in a class action lawsuit over allegations that it failed to safeguard patients' personal data during a 2023 data breach. The breach compromised sensitive patient information such as names, Social Security numbers, medical records, and health insurance details. The lawsuit alleged that the surgery center could have prevented the breach by implementing adequate cybersecurity measures. While the center has not admitted any wrongdoing, it agreed to pay an undisclosed sum to resolve the allegations. Under the settlement's terms, affected individuals can claim up to $500 for ordinary out-of-pocket expenses and $7,500 for extraordinary expenses related to fraud or identity theft. California class members are eligible for an extra $50 payment. All class members are also eligible for two years of credit monitoring services, which include credit monitoring across three bureaus, dark web surveillance, real-time inquiry alerts, and $1 million in identity theft insurance. As part of the settlement agreement, Hapy Bear Surgery Center committed to enhancing its data security measures to prevent future breaches. This lawsuit underscores the importance of stringent cybersecurity measures within the healthcare industry, given the sensitive nature of patient data.
