Settlement Summary
Health insurance giant, Aetna, has agreed to a $2 million class action lawsuit settlement, resolving discrimination claims concerning unequal access to fertility treatments for LGBTQ+ individuals. The lawsuit, filed under New York laws, alleged that Aetna's health insurance policies made it unduly expensive for LGBTQ+ members to access fertility treatments necessary to start families. The settlement benefits a class of Aetna members who were denied artificial insemination or in vitro fertilization between September 1, 2017, and May 31, 2024. Despite not admitting any wrongdoing, Aetna has agreed to pay the settlement amount to resolve the issue. The settlement partitions affected members into four categories with each category expected to follow a different process to receive settlement and expense payments. The payments, totaling around $12,300, could be reduced if there are more than 200 participating class members. Additional compensation is also available for those who experienced further losses due to the denial of their infertility coverage. The final approval hearing for the Aetna fertility discrimination settlement is scheduled for October 10, 2025.

- Must be in a relationship where one individual has a uterus and the other partner was incapable of producing sperm due to either being assigned female at birth or being assigned male at birth and later transitioning to the opposite gender
