Settlement Summary

The PACER (Public Access to Court Electronic Records) platform, managed by the United States federal judiciary, recently hit the headlines with a massive $125 million settlement following a class action lawsuit. The suit alleged that the U.S. government had unlawfully overcharged users of PACER, a system meant to provide public access to federal court records. While PACER operates under policies set by the Chief Justice of the U.S. Supreme Court, critics claimed that the fees exceeded what was necessary to cover the system’s operating costs. To qualify for a payout from the settlement, users must have paid PACER fees between April 21, 2010, and April 21, 2016. The minimum payout to each eligible member will be the lesser of $350 or the total amount they paid in PACER fees during the qualifying period. Those who paid more than $350 may receive additional pro-rated payments.
