Settlement Summary
WorkEasy Software LLC (formerly EasyWorkforce) agreed to a $1.69 million settlement to resolve claims tied to fingerprint-based employee time clocks sold under names including WorkEasy, EasyClocking, EasyWorkforce, and TimeLogix. The case centers on Illinois’ Biometric Information Privacy Act (BIPA), a strict state law that treats biometrics like fingerprints as uniquely sensitive identifiers and requires companies to follow specific steps—such as providing written notice, obtaining informed written consent, publishing retention/destruction policies, and using reasonable safeguards—before collecting or storing that data. About 21,915 current and former Illinois employees who used these fingerprint time clocks between June 24, 2016, and Aug. 15, 2023, are included in the class, with payments varying by when a person first used the device. The lawsuit was filed because plaintiffs alleged the company collected, stored, and potentially disclosed fingerprint data through these timekeeping systems without meeting BIPA’s consent and security requirements, exposing workers to long-lasting privacy and identity risks if biometric templates are mishandled or breached. While WorkEasy denies wrongdoing, the settlement reflects the high financial stakes of BIPA litigation—where statutory damages can add up quickly across thousands of employees—and underscores that employers and workplace technology vendors can be held accountable for how biometric time clocks are implemented, not just whether the tools “work” operationally. More broadly, this settlement fits into a wave of BIPA class actions targeting workplace biometrics, from time clocks to access controls, as Illinois courts have allowed large groups of employees to pursue claims even without alleging a traditional financial loss. The cases have pushed employers, HR departments, and vendors toward tighter compliance programs (clear written disclosures, opt-in consent procedures, vendor contract controls, and retention schedules) and have influenced how biometric products are marketed and deployed nationwide, especially as other states consider or expand privacy rules while Illinois remains the most aggressive and plaintiff-friendly biometric regime in the U.S.
