Settlement Summary
Between about 2009 and 2016, certain Mercedes-Benz BlueTEC passenger cars and Freightliner Sprinter BlueTEC II diesel vehicles were sold and driven in the U.S. Diesel engines rely on emissions control systems—such as devices that reduce nitrogen oxides and other pollutants—to meet federal and state clean-air requirements. In this case, the U.S. Department of Justice alleged that the emission control systems in some of these vehicles did not comply with applicable standards under the Clean Air Act, and that the companies also violated other state laws. The result was a settlement that offers eligible owners or lessees a combination of a free repair (an approved emissions modification) and a $2,000 incentive payment. The lawsuit was filed to address those alleged compliance problems and to push for fixes and accountability, rather than leaving owners to bear the cost of correcting an environmental performance defect. This settlement is significant because it’s classwide—meaning many vehicle owners who meet specific eligibility criteria can potentially participate—and it encourages timely installation by tying payment to when the approved modification is completed. The class includes people who own or leased qualifying models and have not yet installed the modification (as well as some who installed it on or after Aug. 1, 2023), but excludes those who installed the AEM before Aug. 1, 2023 or who already received a similar $2,000 incentive after Aug. 1, 2023; claimants generally need proof like title/lease documents and a dealer repair order. It also reflects industry and regulatory pressure: major diesel emissions enforcement typically involves the Clean Air Act, with oversight and actions that can include the EPA, California Air Resources Board, and state attorneys general, and settlements like this have become a familiar path when regulators conclude that software or hardware emissions controls underperform relative to required standards. Broader implications extend beyond one brand or model line: similar emissions-related cases have pushed automakers to provide remedies and incentives, and they highlight how vehicle emissions compliance is judged not just at the time of sale, but through real-world performance against evolving testing and enforcement standards. The $2,000 payment and free AEM installation—handled through authorized dealerships and with defined deadlines (AEM installed by Aug. 31, 2026, and claims filed by Sept. 30, 2026)—illustrate a common settlement pattern that balances environmental obligations with consumer relief, and it signals to the industry that noncompliance can trigger both legal consequences and large-scale owner-focused remediation.
